( المسئولية الجنائية عن ترويج الشائعات الكاذبة ،والمضللة عبر وسائل التواصل الحديثة من منظور فقهي)

ملخص البحث: تعد الشائعات من الآفات المجتمعية الخطيرة والمدمرة للأفراد والمجتمعات، فهي ظاهرة خطيرة معروفة منذ القدم، حيث عرفها الإنسان منذ فجر التاريخ، إلا أنها انتشرت بشكل كبير ملحوظ في مجتمعاتنا المعاصرة؛ نظراً للتطور التكنولوجي الهائل في وسائل التكنولوجيا والاتصال الحديثة، فلا نستطيع أن نتخيل مجتمعاً بكل طبقاته، ومستوياته الفكرية والثقافية، والاجتماعية، والسياسية والاقتصادية، خالياً من الشائعات، فلا تكاد تشرق شمس يوم جديد، إلا ونسمع بشائعة معينة في مكان ما، فترويج الشائعات وباء سريع الانتشار بين الناس، فكم دمرت الشائعات وهدمت من أسر، وكم فرقت بين أحبة، وكم أحزنت من قلوب، وكم أهدرت من أموال، وضيعت من أوقات، وكم أقلقت من أبرياء، وحطمت من عظماء، وأشعلت نار الفتنة بين الأصفياء، وكم دمرت من مجتمعات، فأثارت فتناً وبلايا، وحروباً ورزايا، ويعد هذا الموضوع من الموضوعات المهمة والبارزة في وقتنا الحالي؛ إذ يمس جوهر حياتنا فيما يتعلق بجميع مناحي الحياة، الاجتماعية، والأسرية، والإنسانية، والفكرية والثقافية، والسياسية، والاقتصادية وغيرها، إذ فرضه واقعنا المعاصر؛ بسبب التطور التكنولوجي؛ ونظرا لأهمية هذا الموضوع، جاءت هذه الدراسة لتكشف لنا عن حقيقة الشائعات، وآثارها المدمرة، وهدفت إلى بيان حكم ترويج الشائعات الكاذبة، والمضللة، وبيان العقوبة الجنائية المقررة؛ لمن يقوم بترويجها، من منظور شرعي وقانوني؛ وذلك من أجل تحقيق السلام، والاستقرار بين أفراد المجتمع.  
Abstract: Rumors are among the most dangerous and destructive societal plagues, harming individuals and communities alike. This perilous phenomenon has been known since ancient times, tracing back to the dawn of human history. However, its prevalence has surged dramatically in contemporary societies due to the massive technological advancements in modern communication tools. It is nearly impossible to imagine any society—across all social, intellectual, cultural, political, and economic strata—free from rumors. Scarcely does a new day begin without news of a new rumor spreading somewhere . The promotion of rumors is a rapidly spreading epidemic. Countless families have been torn apart, loved ones separated, hearts broken, wealth squandered, time wasted, innocent lives distressed, great figures undermined, and discord ignited among allies. Entire societies have been devastated, giving rise to strife, calamities, and even wars. This issue is critically relevant today, as it touches the core of our lives across all dimensions: social, familial, humanitarian, intellectual, cultural, political, economic, and beyond. Its urgency is amplified by modern technological progress.Given the gravity of this phenomenon, this study seeks to expose the true nature of rumors and their destructive consequences. It aims to clarify the Islamic legal ruling on promoting false and misleading rumors, outline the prescribed criminal penalties for perpetrators from both Islamic law and legal perspectives, and ultimately contribute to fostering peace and societal stability.
