الكفاءة بين الزوجين( دراسة أصولية- قانونينة)

ملخص البحث:الحمد الله الذي يسر لي إتمام هذا البحث الممتع الشاق، فهذا الموضوع من المواضيع المهمة في فقه الأسرة؛ فهي تبين مكانة المرأة في الإسلام؛ مما يدرء شبهات من يدّعون إهانة المرأة في الإسلام، وبعد التنقل بين الكتب الفقهية التراثية الخاصة بهذا الباب، تبين لي أن الكفاءة بين الزوجين من الأمور التي اختلف فيها الفقهاء، ومنشأ الخلاف عندهم هل الكفاءة شرط صحة أم شرط لزوم في النكاح؟ فمن اعتبرها شرط قال بمشروعيتها، ومن لم يعتبرها شرط لم يقرّ بمشروعيتها، ويمكن تعريف الكفاءة بين الزوجين بأنه تساوي الزوجين في صفاتٍ مخصوصة ومعلومة؛ تؤدي إلى استدامة الحياة الزوجية بينهما ، وقد سلكت في هذا البحث المنهج الاستقرائي الاستنباطي، وذلك باستقراء نصوص الفقهاء في المسائل محل الدراسة، واستنباط الحكم الشرعي منها، وقد خلصتُ ببعض النتائج منها ما يلي: المراد بالكفاءة بين الزوجين هو تساويهما في صفات مخصوصة ومعلومة؛ تؤدي إلى استدامة الحياة الزوجية بينهما، كما نص الفقهاء ( رحمهم الله تعالى) على أن الوقت الذي تعتبر عنده الكفاءة هو ابتداء عقد الزواج، ولا يضر زوالها بعدها، و ذهب الفقهاء( رحمهم الله تعالى)  إلى اعتبار الكفاءة حق للمرأة وللأولياء، كما ذهب جمهور الفقهاء( رحمهم الله تعالى) إلى أن الكفاءة في عقد النكاح تُعدّ شرط لزوم إلا في استثناء بعض الحالات، فينتقل الحكم من كونه شرط لازم إلى شرط صحة، وعند النظر المقاصدي للكفاءة نجد أن علماء المقاصد اعتبروها مكمل للضروري، وتأتي لاستدامة عقد النكاح وتحقيق الألفة الزوجي، كما اعتبر المنظم السعودي الكفاءة في النكاح ونصت على ذلك المادة الرابعة من نظام الأحوال الشخصية، وقد جاء البحث في مقدمة، وثمانية مباحث، وخاتمة، ثم أتبعته بالفهارس .
Abstract: Praise be to Allah who enabled me to complete this challenging yet enjoyable research. This topic holds significant importance in the field of family jurisprudence, as it highlights the status of women in Islam and refutes the claims of those who allege that Islam degrades women. Through an exploration of the classical juristic texts dedicated to this subject, it became evident to me that jurists have differed on the issue of compatibility  between spouses—specifically, whether it is a condition for the validity of marriage or merely a condition for its binding nature. Those who viewed it as a requirement upheld its legitimacy, while those who did not, rejected its necessity.Compatibility between spouses may be defined as the equality of both partners in certain known and specific qualities that contribute to the continuity and stability of the marital relationship. In conducting this study, I adopted an inductive-analytical methodology, by surveying the juristic texts related to the issues under discussion and deriving the relevant legal rulings from them.Among the findings I reached are the following: Compatibility between spouses refers to their equality in particular, well-defined traits that support the longevity of the marital bond. The jurists (may Allah have mercy on them) stipulated that the point at which compatibility is to be considered is at the time of the marriage contract; its absence thereafter is of no consequence. Furthermore, the jurists (may Allah have mercy on them) regarded compatibility as a right belonging to the woman and her guardians. The majority of jurists (may Allah have mercy on them) held that compatibility in marriage is a condition for the binding force of the contract, except in certain exceptional cases where it becomes a condition for validity.From a maqāṣid-based perspective, scholars of higher objectives of Islamic law considered compatibility to be a supplementary component to the essential elements of marriage, contributing to the durability of the marital contract and the establishment of harmony between spouses. Additionally, the Saudi legislator recognized compatibility in marriage, as stipulated in Article Four of the Personal Status Law.This study consists of an introduction, eight main sections, a conclusion, followed by indexes.
