الضوابط الفقهية من كتاب الهداية للمرغيناني) رحمه الله)(في كتاب أدب القاضي) جمعًا ودراسة

هذا البحث يهدف إلى جمع الضوابط الفقهية في المذهب الحنفي المتعلقة بأدب القاضي، مع العناية بشرحها وتوضيحها، والبحث مكون من: مقدمة، وتمهيد، وأربعة مباحث وخاتمة، وفهارس، فالمقدمة تشتمل: على مشكلة البحث، وأهمية، وسبب اختياره، وأهدافه، وحدوده، ومنهج البحث وخطته، أما التمهيد: ففيه نبذه عن الإمام المرغيناني، وعن كتاب الهداية وجهود العلماء حوله، ومنهج الإمام المرغيناني في الضوابط الفقهية في كتاب الهداية، ثم تكلمت عن الضوابط الفقهية في كتاب أدب القاضي وذكرت في المبحث الأول: شروط ولاية القاضي، وفي المبحث الثاني: شروط أهلية القضاء، وفي المبحث الثالث: الإقرار بينّة ملزمه، وفي المبحث الرابع: الجلوس في المسجد للقضاء، ثم ذيلت البحث بالخاتمة وفيها أهم النتائج التي توصلت إليها، وأهم التوصيات التي أوصي بها. منهج البحث: وقد اتبعت في هذا البحث منهجًا استقرائيًا استنباطيًا في جمع الضوابط الفقهية وحصرها في كتاب أدب القاضي من كتاب الهداية للإمام المرغيناني، ومن أهم نتائج البحث: إن كتاب "الهداية" يعتبر من أقوم المتون، وعند ترجمة الإمام المرغيناني تبين مكانته العلمية بين علماء عصره، يقترح أن تتبنى الأقسام العلمية مشروع الضوابط على المذاهب الأربعة وتقسمه على الباحثين لخدمته، وجمع الضوابط الفقهية في المذهب الحنفي عامة ووضعها في موسوعة.
Abstract: This research aims to collect the Fiqh rules in the Hanafi madhhab related to Adab Alqadi, taking care of explaining and clarifying them, and the research consists of: an introduction, a preface, four chapters, a conclusion, and indexes The introduction includes: the problem of research, the importance, the reason for choosing it, its goals, its limitations, the research method and its plan, while the preface contains an overview of Imam Al-marghinani, about Kitab al-Hidaya and the efforts of scholars around it, and Imam Al-marghinani's approach to the Fiqh regulations in Kitab al-Hidaya Then I talked about the Fiqh rules in Kitab Adab Alqadi and mentioned in the first chapter: the conditions of the judge's mandate, in the second chapter: the conditions of the judiciary's eligibility, in the third chapter: acknowledgement of his evidence is binding, and in the fourth section: sitting in the mosque to judge, Then the conclusion which has the most important results I have reached, and the most important recommendations that I recommend.Research methodology: in this research, I have followed an inductive deductive approach in collecting Fiqh guidelines and limiting them to Kitab Adab Alqadi from Kitab al-Hidaya by Imam marghinani, One of the most important results of the search: is that  Kitab " Al-Hidaya " considered one of the most important texts, and when writing about Imam Marghinani appeared to us his scientific status among the scholars of his time, It is proposed that the scientific departments adopt the draft controls on the four schools of thought and divide it among researchers to serve it, and collect the Fiqh controls in the Hanafi school in general and put them in an encyclopedia.
