التعليل بالحكمة عند الأصوليين

العلة هي ركن القياس الأصيل، فلا عبرة بقياس بغير العلة، لكن: هل تقوم الحكمة مقام العلة لاسيما عند خفاء العلة؟ ويقوم البحث جميعه علي إجابة هذا السؤال ، حيث بينت أولًا مفهوم العلة، ومعني الحكمة عند الأصوليين، وذكرت ما بينهما من اتفاق واختلاف، وأسماء الحكمة واستعمالاتها، ثم فصلت القول في قيام الحكمة مقام العلة عند العلماء، وبينت أن من العلماء من منع قيام الحكمة مقام العلة مطلقًا، ومنهم من أقامها مقام العلة مطلقًا، ومنهم من فصل القول، فقالوا بقيام الحكمة مقام العلة متى كانت الحكمة ظاهرة منضبطة ، أما إن كانت مضطربة خفية فمنعوا قيامها مقام العلة  ثم  ذكرت الأدلة والترجيح، وحقيقة هذا الخلاف ومرده، ثم أفردت مسألة في ثمرة هذا البحث، أعني: الفروع الفقهية التي تخرجت علي هذا الخلاف الواقع بين الأصوليين، ثم ختمت البحث بخاتمة مزيلة بأهم النتائج التي يمكن أن تستفاد من هذا البحث.
A reason is the element of authentic measurement. No example is measured without a reason, but: Does wisdom acts as the reason, especially when the reason is hidden? The research is all based on the answer to this question. First, I outlined the concept of reason, the meaning of wisdom for the fundamentalists, and mentioned the agreement and difference between them. And the names of wisdom and its uses, then I detailed the saying of the scholars that wisdom takes the place of the reason، And I pointed out that some of the scholars who prevent wisdom from taking the place of the reason at all، some of them have established it in the place of the reason at all, and some of them have said that wisdom should take the place of the reason when wisdom is apparent and disciplined. But if it is a hidden, then they prevented it from taking the place of the reason, then I mentioned the evidences, and the fact of this disagreement and its reason, and then I singled out an issue in the fruit of this research, I mean: the Fiqh branches that graduated on this disagreement between the fundamentalists, and then I concluded the research with a conclusion with the most important results that can benefit from this research.
