التوازى فى عقود المعاوضات وتطبيقاتها المعاصرة - دراسة فقهية

تهدف هذه الدراسة إلى بيان أهمية العقود المتوازية في مجال الاقتصاد الإسلامي، وبيان أنواع هذه العقود من: مضاربة، إجارة ، سلم، استصناع، مقاولة، مزارعة، مساقاة، إقالة- وبيان أثرها على الاقتصاد. وبيان إسهامها في حل الکثير من المشکلات الفردية والمجتمعية، وأثر ذلک في الرواج الاقتصادي، وتقليل نسبة البطالة، وتوفير متطلبات السوق وحاجيات المجتمع، وبيان أن هذه العقود وسيلة لضمان الربح وتجنب الخسارة، وتضييق فروق السعر بين الشراء  والبيع، وتجنب اللجوء إلى القروض الربوية. ودراسة هذا الموضوع وضبط أحکامه بقواعد الفقه الإسلامي، يظهر ويرسخ صلاحية الشريعة الإسلامية لکل زمان ومکان ولسائر المستجدات، ولجميع المخلوقات.
This study aims to demonstrate the importance of parallel contracts in the field of economics in Islam, a statement of the types of these contracts such as : Mudaraba, Ijarah, Salam, Istisna, contracting, farming, watering, dismissal and its impact on the economy and an explanation of its contribution to solving many individual and societal problems, and its impact on economic prosperity , reducing unemployment, and providing the requirements of the market and the needs of society, and to show that these contracts are a means to guarantee profit and avoid loss, narrowing the price differences between buying and selling, and avoiding resorting to usurious loans and study this subject and its regulation according to the rules of Islamic jurisprudence, shows and consolidates the validity of Islamic law for every time and place and for all developments, and for all creatures .
