إن نظرية الظروف الطارئة لها دور کبير في تخفيف الکثير من الآثار الضارة التى قد تلحق بطرفى العقد نتيجة لتغيير الظروف ، من آثار تطبيق نظرية الظروف الطارئة تحقيق العدالة بين المتعاقدين، ورفع الظلم في الالتزامات العقدية وإعادة لتوازن الاختلال التعاقدي، وتهدف الدراسة من هذا البحث إلى بيان الظروف الطارئة، وأثرها على بعض العقود المالية المعاصرة ومنها عقد التوريد، وعقد المقاولة، والبيع بالتقسيط، وبيان أثر هذه الظروف على الحقوق والالتزامات العقدية لکل منهم.
The theory of emergency conditions has a major role in mitigating many of the harmful effects that may be inflicted on the parties to the contract as a result of changing circumstances, from the effects of applying the theory of emergency conditions to achieve justice between the contracting parties, lift the injustice in contractual obligations and restore the balance of contractual imbalance, and the study aims from this research to show Emergency conditions, and their impact on some contemporary financial contracts, including the supply contract, the contracting contract, and the sale in installments, and an explanation of the impact of these circumstances on the contractual rights and obligations of each of them.
