مما لا شک فيه إن ازدهار الحضارة وانتشار التقدم التقني ساعد في تسهيل الکثير من أمور حياتنا ، وله العديد من الإيجابيات في تطور العلم وانتشار المعرفة ولکنه في نفس الوقت جلب لنا العديد من المخاطر والأضرار والسلبيات المتعلقة بالحاسب والإنترنت ، والتي لم يکن في ذهن مصمميها تلک الأخطار والجرائم التي ترتکب من خلالها، وذلک لأن استخدام شبکة الإنترنت في بدايتها قد اقتصر على مراکز الأبحاث وطلاب الجامعات للاستفادة منها في الأغراض العلمية، ولم يکن في الحسبان ذلک الانتشار الواسع الذي شمل کافة فئات المجتمع.
ومن بين تلک الأمور السلبية الاختراق الإلکتروني إذ هو شکل من أشکال السلوک غير المشروع الذي يرتکب باستخدام الإنترنت ، فمما لاشک فيه إن الاختراق الإلکتروني هو خرق لخصوصية الآخرين وهتک لحرماتهم وتجسس على معلوماتهم وبياناتهم التي لا يرغبون في أن يطلع عليها الآخرون .
ومن المعروف أن الاختراق بصفة عامة يعني القدرة على الوصول إلي البيانات الموجودة على الأجهزة الشخصية بوسائل غير مشروعة، ودون رغبة صاحب هذه البيانات. وتختلف أهداف الاختراقات، فقد تکون المعلومات هي الهدف المباشر حيث يسعى المخترق لسرقة أو تغيير أو إزالة معلومات معينة، وقد يقوم المخترق بجريمته بقصد إظهار قدراته على الاختراق وتتسبب هذه الاختراقات غير المشروعة في خسائر مادية کبيرة للأفراد والمؤسسات .
ولذلک کان لابد من التصدي لهذه الظاهرة والحد منها وذلک ببيان أحکامها وموقف الشريعة منها .
يشهد عالمنا کل يوم خطوة في التقدم والتطور في العلوم والتکنولوجيا، وبفضل هذا التقدم عرفت مظاهر التقنية الحديثة مثل الهواتف الذکية ، وتعد شبکة الإنترنت أکثر هذه المظاهر أهمية ، فکثرة استخدام شبکة الإنترنت وشيوعها بين عامة الناس جعلها وسيلة للاختراق ومن ثم ارتکاب کثير من التعديات نحو التجسس والتشهير بالسب والقذف فضلاً عن ذلک أن شبکة الإنترنت قد تکون محلاً لاعتداء المخترقين مما يعرض أنظمتها ومعلوماتها للخطر فکان لابد من بيان أحکام الاختراق الالکتروني وما يترتب عليه من
آثار ، ومن هذا المنطلق تظهر أهمية الدراسة.
There is no doubt that the prosperity of civilization and the spread of technical progress helped facilitate many of our lives, and it has many positives in the development of science and the spread of knowledge, but at the same time it brought us many risks, damages and negatives related to the computer and the Internet, which were not in the minds of the designers of these dangers And the crimes that are committed through it, because the use of the Internet at its beginning was limited to research centers and university students to benefit from them for scientific purposes, and it was not taken into account that the widespread spread that included all groups of society.
               Among those negative things is electronic penetration, as it is a form of unlawful behavior committed using the Internet, so there is no doubt that electronic penetration is a violation of the privacy of others and a violation of their privacy and spying on their information and data that they do not wish to be seen by others.
               It is known that penetration in general means the ability to access data on personal devices by illegal means, and without the desire of the owner of this data. The goals of breaches differ, as information may be the direct target where the hacker seeks to steal, change, or remove specific information, and the hacker may commit his crime with the intent to show his abilities to penetrate and these illegal breaches cause significant material losses to individuals and institutions.
               Therefore, this phenomenon had to be addressed and curbed, by clarifying its provisions and the position of Sharia
on it.
               Every day our world is witnessing a step in progress and development in science and technology, and thanks to this progress I have known the manifestations of modern technology such as smart phones, and the Internet is the most important of these manifestations, as the widespread use of the Internet and its popularity among the general public made it a way to penetrate and then commit many violations towards espionage The defamation of insults and defamation, in addition to that, the Internet may be a place for attacking infiltrators, which exposes its systems and information to risk, so it was necessary to clarify the provisions of electronic penetration and its implications, and from this standpoint the importance of the study.
